INTRODUCTION

This app gathers some items of Personal Information from Users, but only for the purposes identified, and mainly to produce the transportation agreement.

1.1 Personal Information

These “Sales, Contract, and Transportation Terms and Conditions” do not address our privacy policy, which instead may be found at www.busforfun.com/privacy-policy.

1.2 – Website Owner

1.3 – Effective Date for these Conditions

These terms of use shall be effective from January 1, 2016 until the next update.

2 – General Contract and Transportation Conditions

2.1 – Foreword

Busforfun.com S.R.L. (Tax / VAT I.D. # 04322330277) owns a transportation and travel agency which handles individual travel to specific events (hereinafter, “Events”) primarily, though not exclusively, via medium- to long-distance coach-bus routes, in association with industry leaders (hereinafter, “Carriers,” and/or “Partner Companies”), who partner with us using their own staff, equipment, and vehicles, albeit in accordance with the standards of quality set by busforfun.com, S.R.L., and in compliance with all applicable Italian and EU laws and regulations, as well as the provisions set by any relevant administrative body with authority over this industry.

2.2 – Limits of Applicability

These “Sales, Contract, and Transportation Terms and Conditions” govern all interactions between travelers and busforfun.com, S.R.L., which related to one or more of the transportation services posted and offered on busforfun.com, whether directly or on behalf of Carriers.

2.3 – Modifications

Any change or addition, and moreover any term or condition conflicting in whole or in part, to the present Sales, Contract, and Transportation Terms and Conditions becomes effective only if explicitly approved in writing by Busforfun.com, S.R.L.

2.4 – Reserving Travel – Termination of Contract

Travel may be booked:

  1. At busforfun.com using the online reservation procedure;
  2. Using the busforfun.com App (anticipated release date: March 2016) for smartphones, available free at the Apple App Store, or on Google Play;
  3. At any authorized ticket office or sales kiosk;
  4. From authorized dealers;
  5. Never on board the coach.

A reservation constitutes a formal offer by the traveler to enter into a transportation agreement with Busforfun.com, S.R.L. and with any Partner Companies tasked with co-chairing the requested transport service.

The contract between the Parties shall be fully consummated:

  • Once the traveler receives a reservation confirmation in the form of a single-use Voucher from busforfun.com, S.R.L.;

No traveler shall be allowed to board without a reservation and without an available seat.

By booking travel, traveler acknowledges he/she has read and accepted these Sales, Contract, and Transportation Terms and Conditions, as well as the information given to him/her by Busforfun.com, S.R.L. and/or by an authorized representative of the same, and further avers he/she has the legal capacity to enter into this agreement, as well as the right to assume responsibility in the name of, and on behalf of, any third party accompanying him or her.

2.4.1 – Minimum Passengers

NOTE: Trips will be canceled unless at least 16 (sixteen) travelers have booked. Passenger-customer explicitly acknowledges his/her awareness of this condition.

2.4.2 Stops on Request

NOTE: On routes where stops may be made on request, traveler must expressly book the stop, by checking the availability and consulting the relevant timetables, by the established deadline, and confirm his/her express wish to end his/her travel at the requested stop by notifying the driver once aboard.

2.5 – Payment Methods

In consideration for the service purchased, the traveler must pay the fare owed at the moment travel is booked, or by the end of the contract, which will be present in his or her “cart.”

A variety of payment methods are accepted, based on the type of reservation made:

Online bookings or reservations made by App:

  • PayPal;
  • Credit card (VISA/MasterCard); Visa Electron, UnionPay, JTB, PostePAY, American Express);

Cash: at any participating ticket office or agency;

  • Wire transfer;
  • Italian postal transfer (where available);
  • NEVER IN CASH ON BOARD.

2.6 – Vouchers

Only one purchase code (hereinafter “Voucher”) may be used per reservation, by any purchase-code holder. Vouchers may only be used for online reservations or at any authorized agency.

Vouchers may only be used according to the terms and restrictions for the same. In general, Vouchers may ONLY be used for full-price fares: any exception must be explicitly posted and/or communicated in writing by busforfun.com, S.R.L.. These regulations may be waived during special promotional periods. In most cases, Vouchers cannot be combined with other promotional offers.

2.6.1 – Voucher Use

Busforfun.com’s voucher-marketing campaign allows for a maximum of three vouchers per user. If a user redeems more than three voucher codes, Busforfun.com, S.R.L., may cancel all reservations beyond the first three tickets. These regulations may be waived during special promotional periods.

2.6.2 – Complimentary Vouchers

Vouchers provided free of charge all have an expiration date, noted in writing. Such vouchers, given out as part of a marketing campaign, expire once the reservation is completed.

2.6.1 – Voucher Resale

Reselling a voucher is not permitted, is prohibited, and such conduct will be sanctioned by Busforfun.com, S.R.L., by canceling tickets and/or by filing suit for damages.

2.7 – Tickets

Upon receipt of the agreed-upon payment from the traveler, Busforfun.com, S.R.L. will issue a travel pass (hereinafter also denoted “ticket”) related to the booked itinerary and to the person(s) whose first and last name were entered at the reservation stage.

For online reservations, the ticket shall be the emailed reservation confirmation (sent to the address provided by the traveler), which may be displayed, when required, as either a paper or electronic (PDF) copy along with a valid identity card matching the information on the ticket itself.

2.8 – Ticket Holders

Tickets are personal and non-transferrable. They give the traveler the right to any seat once aboard the coach. Open-seating notice: travelers may not reserve a particular seat.

Those traveling with small children, pregnant women, or persons with reduced mobility shall have first choice of seat, and will be allowed to pre-board. Other passengers’ cooperation is expected but not enforced.

Tickets (electronic or paper, as the case may be) must be retained throughout the entire trip and must be displayed on request to Busforfun.com, S.R.L. staff or to any authorized representative thereof.

2.9. – Ticket Validity

Tickets are valid for a single trip, on the departure day and time noted on the same. Any erasures and/or markings on the same shall void the ticket, and the passenger shall not be permitted aboard.

No traveler will be permitted aboard unless in possession of a valid ticket.

2.10 – Trip Modification by Traveler

Any change to a reservation (meaning, any modification to passenger(s)’s name, route, departure time or date) may be made up to fifteen (15) days prior to the scheduled departure date. Busforfun, S.R.L. must be notified using the appropriate procedure on busforfun.com or via any participating ticket office or agency.

Changes to existing reservations may be made free of charge up until the fifteenth (15th) day before the date of travel, with no extra fees assessed, provided seats at the same or at a lower fare are still available at the time of the request.

One of the two scenarios will then apply:

  • Where there has been a fare increase since the original booking, the traveler must pay the fare difference as a supplemental charge.
  • Where there has been a fare decrease since the original booking, the traveler shall not have the right to a reimbursement of the difference in fare.

2.11 – Trip Cancelation by Traveler

Trips may be canceled up to fifteen (15) days before the scheduled departure date. Busforfun, S.R.L. must be notified using the appropriate procedure on busforfun.com or via any participating ticket office or agency.

2.11.1 – Cancelation Fee

For all trips properly canceled via the procedure noted above, the traveler shall have the right to a refund of the amount paid less € 9.00 (NINE AND 00/100 EURO), which will be retained as an administrative-processing fee by Busforfun.com, S.R.L.

Should the amount paid be less than € 9.00, Busforform.com, S.R.L. will retain the lesser amount as an administrative-processing fee.

2.12 Travel and Event Tickets or Hotel Booking

NOTE: For travel reservations that include admission to a performance, concert, other event or an hotel booking, the cancelation will never affect the admission ticket, which shall always be non-refundable.

The preceding clause may be only be modified (in whole or in part) via written communication from Busforfun.com, S.R.L.

2.12.1 Trip Cancellation Communicated to Bus Driver

Travelers may NOT communicate trip changes or cancelations to the coach driver; such attempts will not entitle travelers to any refund whatsoever.

2.13 – Method of Refund

Any traveler who has properly effected a trip cancellation in accordance with the procedure described above, shall have the right to a travel credit in the amount of the fare paid at booking, issued in the form of a voucher. Such voucher shall specifically exclude the value of any admission ticket to a performance, concert, other event or hotel booking. Cancellations will NEVER affect the admission ticket, which shall always be non-refundable.

Such vouchers must be used within twelve (12) months of the issue date to book travel of equal value.

  • If the fare is higher with respect to the refunded trip, the traveler must pay the difference;
  • If the fare on the new trip is lower than the refunded one, the voucher will retain the difference, and may be used for further travel, provided it is booked within twelve (12) months of the original reservation date.

Vouchers may NEVER (whether in whole or in part) be redeemed for cash.

The same terms and conditions in effect at the time of the original booking will apply to travel booked using the refund voucher.

Changing or canceling the new, or any subsequent, reservations, however, will not give the traveler the right to a refund or cash redemption, but only to a travel credit in a corresponding amount.

2.14 – Applicable Regulations

Please note that should a travel reservation be completed electronically (online, or using our app on your smartphone), regulations governing contract annulment for long-distance contracts or those completed at locations other than a store pursuant to Italian Legislative Decree n. 206/2005 (Consumer Code) shall not apply.

Thus, should a traveler cancel his/her trip, the present Terms and Conditions alone shall apply, and for any subject not covered, applicable law shall supply the missing terms and conditions.

3 – Trip

3.1 – Schedules and Routes

Routes, arrival/departure locations, arrival/departure dates and times for all coach buses managed by Busforfun.com, S.R.L. may change (even without notice) due to technical circumstances not under Busforfun.com, S.R.L. or its Partner Companies’ control, and/or due to force majeure, just cause, and/or to comply with an administrative provision or order.

3.1.1 – Changes

Changes to coach arrival/departure times subsequent to the reservation date, happening through no fault of Busforfun.com, S.R.L. and or that of its Partner Companies, shall not entitle travelers to a refund provided the difference between the original and modified arrival/departure time is equal to or less than two hours.

For changes to arrival/departure times greater than two hours, the traveler may terminate his/her contract, without any extra costs or expenses, provided the coach has not yet departed.

In those cases, we invite travelers to contact the Help Desk by fax, +39 0418633132 (for calls placed in Italy: the cost will be equal to land-line rates as set by the carrier), or via email sent to info@busforfun.com, stating your intent to terminate the contract.

3.2 – Trip Starting Point

Travelers must arrive at the stop (indicated on their ticket) least fifteen (15) minutes prior to departure time.

3.2.1 – Bus Check-in

Before departing, the traveler must identify him/herself when requested by the driver or other personnel, by displaying a ticket and valid i.d.

Each reservation has a unique number, which will be displayed on the ticket, with an unambiguous QR, and for group sales, the group shall have a single ticket bearing the list of all travelers’ names.

3.2.2- PASSENGER NO SHOW

Where a passenger fails to appear (passenger no-show), the transportation contract shall be deemed fully completed, and traveler shall have no right to refund.

3.2.3- Passenger No Show Following Changes to Departure Times

Where Busforfun.com, S.R.L. has notified the traveler via text message, email, or otherwise in writing (as consented to by the traveler at the time of booking), of a delay to the reserved coach bus, paragraph 3.2.2, supra, shall apply to the new scheduled departure time.

3.3 - Transfers and Connections

Coach routes are generally intended to provide a non-stop connection between departure and destination cities.

In some cases, to provide access for passengers in out-of-the-way areas, where a coach transfer proves necessary, Busforfun.com, S.R.L. guarantees travel to the arrival city as booked, which may be effected using other companies’ buses, cars, or trains.

Where a destination is particularly distant, or lacking acceptable connection options, thereby necessitating an overnight stay, travelers will be offered a free stay in mid-level (three-star) accommodations; where such direct booking is unavailable, Busforfun.com, S.R.L. shall reimburse travelers for one-night’s hotel stay, up to a maximum of € 80.00.

NOTE: Busforfun.com neither guarantees, nor assumes any liability for, connections or transfers not managed and carried out by Busforfun.com, S.R.L. or by a Partner Company.

3.4 – Traveler’s Responsibilities

Aboard the coach bus or any other vehicle used (except in the case of country-specific regulations and/or more restrictive conditions set by a particular Carrier), passengers must abide by all instructions given by drivers and escorts throughout the trip, and moreover, to the general rules listed below:

  • Do not speak to, or distract the driver in any way while he/she is driving the coach;
  • Do not bother other passengers;
  • Occupy only one seat;
  • Wear your seat belt and any other restraint devices as available;
  • No smoking (including e-cigarettes), no consumption of alcoholic beverages, or ingestion of mood-altering substances;
  • Do not transport dangerous and/or toxic substances and/or articles;
  • Do not throw anything out of the windows;
  • Obey any rules displayed on signs posted within the coach by the carrier;
  • Keep the coach and its equipment clean;
  • Do not block or loiter in the entrances and exits to the coach unless for a legitimate purpose;
  • Exit the coach during stops when requested by the driver or any police/customs authority;
  • Do not do anything to compromise the normal, safe completion of the trip or the quality of service offered therein;
  • Do not transport firecrackers, fireworks, offensive articles, or weapons (even toys) unless disassembled and secured in appropriate cases.
  • Drinking (especially alcoholic beverages) and eating is not allowed unless permitted by the driver.

3.5 – Property Damage to the Vehicle

The traveler is liable to busforfun.com, S.R.L. and/or its Partner Companies handling transportation services for all damages to the coach or to its equipment caused by the negligent or intentional conduct of the traveler him/herself.

Any traveler who either intentionally or negligently damages and/or sullies the coach or its equipment must pay a cleaning fee to Busforfun.com, S.R.L. of € 500.00 (FIVE HUNDRED AND 00/100 EURO) unless the damage totals a greater amount. That amount may be waived or reduced if the traveler proves (respectively) that he/she did not cause the damage, or that the total damage was less than the flat rate listed above.

3.6 – Immediate, Unilateral Contract Termination

Busforfun.com aims to provide a pleasant experience for all travelers.

Consequently, as a matter of common courtesy, Busforfun.com, S.R.L. reserves the right to terminate a travel agreement where a traveler – despite being given a verbal warningchooses to behave in a manner inconsistent with safety regulations, or in a manner so offensive as to render continuing the trip with him/her aboard unacceptable for the carrier, driver, or for the other passengers, or for a combination of the same.

4 – International Travel

For international travel that includes one or more border crossings, passengers acknowledge they must carry an appropriate, non-expired travel document that permits them to leave the country.

4.1 Traveler must furthermore:

  1. Carry on his/her person all non-expired and valid travel documents, and Italian Identity Card (or passport) before departing as required by the particular route, and to display these when asked by the Busforfun.com, S.R.L. or Partner Company driver or assistant, or by the authorities;
  2. To carry only duty-free (in terms of category and quantity) goods with them;
  3. To facilitate customs operations, avoid locking any checked luggage;
  4. To unambiguously identify all of your own luggage.

4.2 Indemnification

The traveler is responsible for abiding by all immigration regulations regarding documents and/or travel visas, as well as currency, customs, and health regulations.

Travelers alone shall bear the consequence of failing to abide by such regulations (including, but not limited to, denial of entry into the destination country), and none shall be imputed to Busforfun.com, S.R.L. nor to its Partner Companies, even if such regulations changed between booking date and travel date. In the remote chance that such a situation occur, duties under the present travel agreement shall be considered fully discharged.

4.3 Continuation of Trip in Progress

WARNING: Should one passenger not be compliance with border-crossing regulations (for example, due to a missing or expired travel document) and should that passenger be stopped by the border authorities, he/she shall be deemed to know that the coach will continue on the route without him/her aboard.

5 – Children

Subject to the requirement to wear seat belts throughout the trip (when required), the following regulations apply to minor travelers.

Should a scenario arise not falling under the categories listed below, you must coordinate an alternative with Busforfun.com, S.R.L. by sending an email to info@busforfun.com BEFORE booking travel.

5.1 Rules for Traveling Minors

Children ages 0 – 3 years

May ride on Busforfun.com, S.R.L. routes only in car seats approved for small children. Those seats must be carried by those accompanying the children, and during the trip they must be secured at two points using the seat belts present aboard. Busforfun.com, S.R.L. assumes no responsibility for the safety and legal compliance of the car seats brought aboard by those accompanying the minors

Children under 15

May only ride if accompanied throughout the trip by the person standing in loco parentis, or who has custody, or someone over the age of 18 bearing a properly executed power of attorney signed by the child’s legal guardian.

Busforfun.com, S.R.L. and its Partner Companies explicitly waive any liability with regards to monitoring children on board

INTERNATIONAL TRAVEL

Unaccompanied minors may not travel abroad.

Minors under one meter in height

Where, on the desired trip, a promo fare lower than the reduced fare is available, the lesser amount will apply to the minor’s fare. This guideline applies to reservations with at least one escort for every two minors.

6 – Transport of Differently Abled Passengers

Busforfun.com, S.R.L., within the limits of its ability, aims to provide equal treatment and access to disabled or reduced-mobility travelers, given the technical limitations related to the coach structure, and as listed below.

6.1 – Transportation of Persons with Disabilities or Reduced Mobility

Persons with severe disabilities, or those with reduced mobility with regards to means of transportation, qualify for a reduced fare. Please inquire at the Busforfun.com, S.R.L. Help Desk by emailing info@busforfun.com.

Customer service will then send the appropriate discount-voucher to the passenger. An escort may travel with the person with a severe disability at the same fare, provided the document noting the disabled or reduced-mobility passenger’s limitations include a requirement of a constant escort.

To allow for disabled or reduced-mobility passengers and their escorts to travel, you must communicate your request and obtain the proper voucher from Busforfun.com, S.R.L. prior to booking.

NOTE Where, due to the construction of the vehicle or related infrastructure (including at the stops, stations, and final destination), boarding, travel aboard, or disembarking the coach should prove impossible and/or unsafe for disabled or reduced-mobility travelers, Busforfun.com, S.R.L. reserves the right to refuse the reservation, not to issue the voucher, or otherwise issue a ticket.

In such cases, Busforfun.com, S.R.L. shall advise the person in question of any and all acceptable transportation alternatives, whether managed by Busforfun.com directly or on behalf of its Partner Companies.

6.2 – Escorts

Due to vehicle construction, travel aboard the coaches and boats managed by Busforfun.com, S.R.L. for the time being is only possible if the disabled or reduced-mobility passenger is able to take the trip independently, without the assistance of others. If not, the traveler may request to be accompanied by a person of his/her choice who is able to provide the assistance needed, thereby removing the impediment to the passenger’s travel aboard the coach.

The disabled or reduced-mobility passenger has the right to have his/her wheelchair or other similar assistive device transported for free in the vehicle’s hold. To ensure the device may be properly transported, the passenger must provide Busforfun.com, S.R.L., the assistive device’s specifications prior to making a reservation.

6.3 – Motorized Assistive Devices

Due to vehicle construction, we cannot in all but the rarest of occasions transport motorized wheelchairs.

7 – Transporting Animals

It is generally impossible to transport dogs, cats, and other animals in on long-distance (greater than 50 km) routes because the construction of the bus does not allow for adequate filtering of the related allergens.

7.1 – Exception: Transporting Animals

Guide dogs (meaning seeing-eye dogs or other guide dogs) accompanying severely disabled persons are transported for free, as long as a document certifying the relevant disability is provided. To ensure the guide dog may be transported, the passenger must notify Busforfun.com, S.R.L. prior to booking travel.

8 – BAGGAGE

In accordance with European regulations, the traffic code, and for safety reasons of those aboard, all carry-on luggage must be placed in the over-head bins in the passenger compartment, or below the seat in front of you.

Where that is not possible, baggage must be placed in the coach’s hold. Generally, the provisions above may not be modified.

8.1 Passenger Baggage Service

Baggage service included in the ticket price is strictly limited to two items per person, meaning one checked and one carry-on item:

  • Checked Luggage: maximum dimensions 67x50x27 cm and maximum weight 20 kg.
  • Carry-On Luggage: maximum dimensions 42x30x18 cm and maximum weight 7 kg.
  • Personal Item: One small purse/backpack up to 35 x 20 x 20 cm per passenger.

Each bag MUST be labeled with the passenger’s name and address so that the items may be properly identified, and to avoid lost or mixed-up baggage. This procedure will further allow for lost items to be returned to their rightful owner.

8.2 – Oversize Baggage

Requests for transporting oversize baggage (for example, sports gear), must be made by the traveler before booking, and must be confirmed by Busforfun.com, S.R.L., who in turn reserves the right to accept or reject the item at its sole discretion and within the limits of space availability. That said, there is no (general) right to have oversize baggage transported.

“Oversize Baggage” includes all luggage with dimensions greater than those listed above, or weighing more than 30 kg, or both.

8.3 – Strollers

Passengers are transported as “oversize baggage” (limit one per passenger) for free, and must be foldable. Non-folding strollers may not be checked or transported aboard.

8.4 – NON Transportable Baggage

In general, the following items may not be checked or carried aboard: home furnishings, furniture or furniture parts, electrical devices, surfboards, cardboard boxes, orthopedic devices, plants and trees, bicycles with or without gears, any type of ski (except for travel to the mountains, or for ski trips), musical instruments, including empty cases, which are not considered baggage and are treated according to the specific regulations contained in these Terms and Conditions.

8.5 – Limitations on Liability for Baggage Service

Carry-on luggage, and its contents, shall remain under the custody and control of the passenger. Should a passenger note unauthorized access to his/her baggage, he/she must promptly notify the bus driver. Before completing their trip, travelers bear the responsibility of ensuring that no items are missing from their carry-on luggage.

NOTE: Except in cases of gross negligence or intentional misconduct, Busforfun.com, S.R.L. shall not be held responsible for missing or damaged carry-on luggage or to the contents of the same.

NOTE: it is absolutely forbidden to place fragile or valuable objects (e.g., cash, jewels, precious metals, keys, glasses or sunglasses, electronic devices [iPads; tablets; laptops; mp3 players; cell phones; cameras; etc.], contact lenses, prosthetic devices, medicine, important papers [diplomas; report cards; certificates; passports; licenses; credit devices; etc.]) in checked luggage. Rather, these items must be placed in carry-on luggage, and must be carefully guarded by the passenger him/herself.

Should these items be transported in the checked-luggage compartment, Busforfun.com, S.R.L. shall not be held responsible for any theft of, or damage to, the same except in cases of gross negligence or intentional misconduct.

NOTE: We note – and the passenger acknowledges at the moment of booking a reservation – that there is no insurance coverage for items left or forgotten aboard the coach.

8.6 – Lost Articles

Should a passenger forget something on board, he/she must fill out a lost-item form, which may be downloaded at busforfun.com. The passenger must contact the Help Desk exclusively via fax at +39 0418633132 (for calls placed in Italy: the cost will be equal to landline rates as set by the carrier) or via email: info@busforfun.com specifying the problem.

9 – PASSENGER’S RIGHTS

9.1 – Passenger’s Rights for Delayed or Canceled Trips

Where a trip is canceled or delayed, Busforfun.com, S.R.L. shall notify passengers as soon as possible, and in any case no later than sixty minutes after the previously scheduled departure time, providing the updated anticipated departure time.

Busforfun.com, S.R.L. offers all passengers (and, in particular, to those who depart from un-manned stops) the possibility of receiving information relating to cancelations or delays on their mobile devices.

NOTE: The transmission of such information is subject to the traveler’s having provided his or her personal information (cell-phone number or email address).

When it is reasonably foreseeable (especially due to force majeure such a coach-bus breakdown, unforeseeable weather events, street closures, traffic congestion, political events, riots, or any other unexpected event)that a departure might be delayed by more than one-hundred-twenty minutes (two hours) or where a greater number of reservations were accepted compared to available seats (hereinafter, OVERBOOKING) the traveler may choose one of the following:

  • A full refund of the amount paid for the trip;
  • Where feasible, to continue the trip, or to re-route via reasonable alternate transportation through to the original final destination.

Refunds shall be paid via wire transfer (unless the traveler accepts an alternate form of payment) within thirty (30) days of the moment Busforfun.com, S.R.L. receives the request, or from the moment in which the traveler has been offered options 1 and 2, supra.

9.2 – Cancellation of RETURN Travel

Busforfun.com, S.R.L. offers travelers complimentary accommodations in a hotel or other lodging, and hotel transfer from the boarding site, where a one-night’s hotel stay becomes necessary due to a RETURN trip being canceled, as well as in cases where a departure is delayed by more than 240 minutes for routes longer than three hours and with departures after 10 p.m.

Busforfun.com, S.R.L. limits the costs of such accommodations, exclusive of coach-hotel transfer, to € 80.00 per traveler per night, for a maximum of two nights.

There shall be NO RIGHT to a complimentary hotel stay where Busforfun.com, S.R.L. proves that such cancelation or delay was caused by conditions including but not limited to: strikes, legislative or administrative action or other unexpected and unavoidable events, coups d’état, riots, civil unrest, revolts, acts of vandalism, earthquakes, avalanches, landslides, or other weather events such as hail, rain and snow, and any other natural disasters sufficient to compromise the safe and appropriate level of service aboard the coach bus.

Should the coach breakdown during the trip, Busforfun.com, S.R.L. shall offer the traveler the opportunity to continue the trip using another vehicle from the breakdown site, or a transfer from the breakdown site to a via point and/or station from which the trip may be continued.

9.2 – Indemnification: Busforfun.com, S.R.L.

Busforfun.com, S.R.L. shall not be responsible for bodily harm or property damage to the traveler, where it results from the traveler’s own failure to abide by the rules, requirements, regulations, and/or provisions in force aboard the coach, and/or set by the driver and/or in any case established by Busforfun.com, S.R.L., as well as through any negligent or imprudent act by the traveler him or herself.

Furthermore, Busforfun.com, S.R.L. shall not be held responsible for bodily harm or property damage to the traveler, where it results by accident or force majeure (including but not limited to, bodily harm or property damage caused by strikes, legislative or administrative action or other unexpected and unavoidable events, coups d’état, riots, civil unrest, revolts, acts of vandalism, earthquakes, avalanches, landslides, chemical or radioactive leaks, consequents of an atomic scission, fuel shortages, and weather events such as hail, rain and snow, and any other natural disasters and other unexpected and unavoidable events that render carrying out the intended service impossible) or by any other act or cause not imputable to Busforfun.com, S.R.L.

Where a traveler dies or is personally injured, and/or where baggage is lost or damaged as a result of an accident arising out of the use of the coach itself, Busforfun.com, S.R.L. – where the same would be held civilly liable according to the Italian civil law in force at the time – shall pay for damages to the person and/or to the personal property according to the limits established by law.

10 – Claims

With the exception of requests for damages permitted under the present Terms and Conditions, any claims by the traveler may be communicated to Busforfun.com, S.R.L. via the form available at busforfun.com. The traveler must contact the Help Desk exclusively via fax at +39 0418633132 (for calls placed in Italy: the cost will be equal to landline rates as set by the carrier) or via email: info@busforfun.com and make note of his/her particular need.

Claims must be communicated within 30 (thirty) days of the date in which the transportation was provided, or should have been provided, and will be handled by Busforfun.com, S.R.L. in accordance with the provisions of Regulation n. 181/2011 of the European Parliament and Council related to coach/bus travelers’ rights.

11 – Reviews and Comments; Other Posted Content

We welcome your reviews, comments, and other posts. You may also submit other correspondence, suggestions, ideas, comments, questions or other information, as long as the content is not illicit (that is, obscene, derogatory, threatening, defamatory, or in violation of privacy or intellectual-property rights, or in any way offensive to busforfun.com and/or others or deplorable, and as long as it does not contain viruses, political or religious propaganda, commercial solicitation, chain messages, marketing messages, mass emails, or any other form of spam).

The use of a fictitious email address, or pretending to be another person or subject in such a way that damage or disservice to us or to others may result, are all prohibited. Busforfun.com, S.R.L. reserves the right to remove or modify such content.

11.1 Social-Media Posting

If you decide to send content or material, except as otherwise noted by us, you hereby acknowledge our non-exclusive, free-of-charge, sub-license and transferable right to use, reproduce, change, edit, post, translate, create derivative works, distribute, and display anywhere in the world such content by any means of communication including on our website and on any social-media profile we maintain.

11.2 – User’s Consent to Publication

If you decide to post content on social-media profiles managed by busforfun.com, S.R.L. you acknowledge and hereby consent to all reasonable and necessary steps to highlight your content on our site and/or our social-media network.

Should you feel that the content published on busforfun.com or on any social-media site traceable to the same contains a defamatory statement, or that your intellectual-property rights have been violated by an article or by information present on the site, we invite you to contact us by email at info@busforfun.com, and we will promptly investigate the issue.

12 – Applicable Law – Jurisdiction – Forum Selection

The contractual relationship between the traveler and Busforfun.com, S.R.L. and/or any Partner Company engaged to carry out the service is to be interpreted, performed, and governed in compliance with Italian Law.

Any dispute arising between the Parties regarding the interpretation, performance, termination, or conclusion of the present contract shall be subject to Italian jurisdiction and shall be heard exclusively by the Court of Venice.

12.1 – Applicable Regulations

For any issue not expressly contemplated by the present Sales, Contract, and Transportation Terms and Conditions, the Italian Civil Code and applicable transportation laws shall supply the missing terms and conditions.

12.2 – Severability

Should one or more clauses in these Terms and Conditions (or in any subsequent agreement incorporated into the same) be deemed entirely or partially void, such a determination shall not affect the other clauses in the contract.
